Simplified Recording Fees Take Effect July 1, 2025

With the passage of HB24-1269, Colorado will implement a new, simplified recording fee structure beginning July 1, 2025.

The current fee of $13.00 for the first page and $5.00 for each additional page will be replaced by a flat $40.00 recording fee for all document types—except for death certificates and verification of death documents, which will no longer have a base recording charge.

In addition, two surcharges will still apply:

  • A $2.00 Electronic Recording Technology Board (ERTB) surcharge
  • A $1.00 Clerk and Recorder technology fee

This brings the total cost to $43.00 per document, regardless of the number of pages.

Key Considerations:

  • Page count no longer matters—but document count does. Be mindful of any additional documents you may need to record, such as Power of Attorney, Statement of Authority, etc.
  • Death Certificates and Verification of Death Documents:
    • There will be no base recording charge.
    • The $2.00 ERTB surcharge is waived, but the $1.00 Clerk and Recorder fee still applies.
    • Some counties may choose to absorb this $1.00 fee, but most will not—so plan on paying $1.00 per death-related document.
  • Subdivision Maps and Other Maps that Combine/Divide Property will also be recorded at the flat rate of $43.00.
  • Land Survey Plats and Plats will be recorded at $43.00, plus any additional fee set by the county surveyor (not to exceed $40.00). In most cases, only surveyors will be submitting Land Survey Plats

Although the cost to record shorter documents will increase, the total fee for typical real estate transactions—such as recording a deed and deed of trust—will be comparable or even less than under the old structure. More importantly, the predictable flat rate eliminates guesswork, reduces the risk of rejection due to underpayment, and results in time and cost savings for title companies and agents.
