Clerk and Recorder Updates 10_21_2020

LTAC has created a spreadsheet to keep on with information on closures of county clerk and recorders offices around the state. posted in the latest news  Please click here for the current version dated 05_31_ 2020.  If you have updates or new information feel free to send them to [email protected] and we will add them to the next version.  

Clerk and Recorders office have been inundated with emails and they have asked that we limit email inquiries to essential items.  If you have questions about whether or not they are recording please check their websites first.  

As you know, many counties are closed to the public and are only taking e-recording or mail-ins at this time.  If you are not set up to e-record we encourage you to contact an e-recording vendor to get set-up.   Here is a link provided to us from the County Clerks Association that has a list of e-recording vendors.  I want to send a special shout out to LTAC member companies on that list CSC, eRecording Partners and Simplifile, for providing this important service to our industry.  

Division of Insurance:
LTAC had a call with the Division of Insurance.  We specifically discussed our concerns regarding 8-1-2 Section 5(L) which has time requirements to submit recordings.   They stated that the regulation specifically discusses submission.  Therefore, as long as we either e-record and document our e-receipt OR send the documents trackable mail and document the mailing receipt we will fulfill that rule.  Note:  when sending documents to clerk & recorders, please check mailing addresses because some get mail at different locations than their physical office.
